Terms and conditions of R Fotografie

Version 1.6 · 24 September 2026. When you book, we record the version and date that apply and provide them in a durable PDF with the proposal or confirmation. Ask for an earlier version at mail@rfotografie.com (Article 2(3)).

Article 1 — Definitions

  1. R Fotografie: the trade name of Rolf Kühr’s sole proprietorship, Dutch Chamber of Commerce number 81531567, Rode Ring 49 N, 1566 HR Assendelft. R Fotografie is the sole contracting party; invoices and liability run through it. Romy and Rolf carry out assignments together, with R Fotografie engaging Romy van Leeuwen Fotografie (sole proprietorship, Dutch Chamber of Commerce number 66388031, based in Uitgeest).
  2. Client: the natural or legal person entering the contract; for weddings, the two partners jointly unless otherwise agreed.
  3. Assignment: the agreed photography service (wedding, newborn, maternity/family, love shoot or business), as stated in the proposal.
  4. Proposal: R Fotografie’s written offer, including by email, stating the service, date, location, scope and price.
  5. Deposit: the amount paid on reservation: €500 for a wedding, €95 for a shoot.
  6. Gallery: the secure personal online space in which images are delivered.

Article 2 — Application

  1. These terms apply to every offer, reservation and contract with R Fotografie. The client’s own terms are expressly rejected.
  2. Departures apply only if R Fotografie expressly accepts them in writing.
  3. The version in force when the contract was formed continues to apply. Changed terms apply only to new assignments unless the parties expressly amend an existing contract.
  4. If a provision is void or voidable, the rest remains in force and a valid provision closest to its intended effect replaces it.

Article 3 — Formation and reservation

  1. An offer is without obligation and valid for 14 days from its date, unless otherwise stated.
  2. The contract is formed when the client accepts the proposal and pays the deposit.
  3. Provisional reservation (once online booking is activated): after the deposit is paid, the chosen date is held provisionally for 14 days. R Fotografie checks its schedule, travel time and feasibility and makes a personal decision within that period. The booking is final when R Fotografie confirms it in writing.
  4. Rejection: if the assignment cannot be accepted, the deposit is refunded in full, without charge, by the same payment method within 14 days. Rejection gives no right to damages.
  5. If payment fails technically or expires, the provisional reservation lapses without charge; the client may book again while the date remains available.
  6. We record the versions of these terms and the privacy notice that applied when booking and provide them to the client in a durable form.

Article 4 — The two photographer promise and absence

  1. R Fotografie promises that Romy and Rolf photograph every accepted wedding together. This is a core part of the contract.
  2. If force majeure, including illness, an accident or a death in the immediate family, leaves only one of them available, R Fotografie offers the client a choice of:

a. one of them together with a second photographer from R Fotografie’s own circle, at the same price. That photographer has the same two advance conversations as Romy and Rolf: an introductory meeting and a meeting shortly before the wedding; or

b. one photographer with a 15% reduction in the wedding fee; or

c. cancellation without charge and a full refund of all sums paid.

  1. If option 2(a) is not feasible, for example because there is too little time for those conversations or no one from the circle is available, R Fotografie seeks a replacement and presents that choice to the client beforehand. If the client is not satisfied, the client may still choose 2(b) or 2(c).
  2. If force majeure prevents both photographers from attending, R Fotografie makes reasonable efforts to arrange an equivalent replacement team. If the client does not approve or replacement is impossible, all sums paid are refunded. Nothing further is owed; Article 12 on liability applies.
  3. R Fotografie informs the client of force majeure or absence as soon as reasonably possible after becoming aware of it.

Article 5 — Prices and payment

  1. Prices are in euros and include VAT unless stated otherwise. Current starting prices appear on the website; the proposal governs.
  2. After the deposit, the balance is invoiced. The final invoice is sent no later than one week before the assignment and paid no later than the day of the assignment, unless agreed otherwise. Additional time arising only on the day (paragraph 4, item 3) is invoiced afterwards.
  3. If payment is late, the client is in default by operation of law. R Fotografie may suspend performance until payment, but not as a means of denying valid consumer rights.
  4. Additional hours:
    1. Agreed in advance: €250 per hour with Basis, €200 with Favoriet and €150 with Luxe, stated in the proposal and included in the final invoice.
    2. Beyond ten hours: the package rate applies through the twelfth hour. From the thirteenth hour, the rate is €300 per hour. These hours are agreed in advance and included in the proposal.
    3. Unplanned overrun on the day: €300 per hour, charged in started 15 minute periods of €75 and invoiced afterwards.
  5. Love shoot credit: if a love shoot was booked and completed within 12 months before the wedding, €75 is credited with Favoriet or €150 with Luxe against the final invoice. There is no credit with Basis.
  6. For travel within the Netherlands beyond 20 km one way from Uitgeest, the charge is €0.39 per kilometre. Travel and any accommodation costs for Italy are stated transparently in the proposal in advance. They change later only because of circumstances beyond R Fotografie’s control, and always after prior discussion.

Article 6 — Right of withdrawal (consumers, distance contracts)

  1. For photography on a specific date or within a specific period (weddings and scheduled shoots), there is no statutory right of withdrawal under Article 6:230p(2) of the Dutch Civil Code, which exempts leisure activities at a specified time. R Fotografie expressly informs the client of this before payment.
  2. For services to which that exemption does not apply, for example a shoot without a fixed date booked remotely by a consumer, a 14 day withdrawal right applies. Performance during that period occurs only at the client’s express request. If fully performed during it, the right expires; if partly performed, a proportionate amount is due.
  3. Where withdrawal is legally available, R Fotografie provides a simple online withdrawal form, in line with requirements effective 19 June 2026. We promptly acknowledge receipt by email. Withdrawal by email to mail@rfotografie.com or by post to the address in Article 1 is equally valid. Using the form is optional.

Article 7 — Rescheduling

  1. An assignment may be rescheduled once without charge to a new date within 12 months, if R Fotografie is available and the request is made at least eight weeks before the original date.
  2. Within eight weeks, rescheduling counts as cancellation followed by a new booking under Article 8, unless the new date is available and R Fotografie grants an exception. For weddings, the specific rule in Article 8(2) takes precedence: if a new date is available, the booking moves at no extra charge.
  3. Already incurred, non-refundable external costs, such as Italy travel or accommodation, are borne by the client unless the rescheduling is attributable to R Fotografie.

Article 8 — Client rescheduling and cancellation

  1. Rescheduling or cancellation must be in writing; email is sufficient.
  2. Rescheduling comes first. If a wedding cannot take place on the agreed date, the parties look for a new one together. If R Fotografie is available, the booking moves at no extra charge and the deposit remains credited. Availability cannot be guaranteed beforehand; R Fotografie responds as soon as possible.
  3. Wedding cancellation: if rescheduling fails or the client cancels, the €500 deposit remains due. Nothing more is due, however close to the date. Sums already paid above the deposit are refunded within 14 days.
  4. For shoots (newborn, maternity/family, love shoot, business), cancellation costs are the €95 deposit up to two weeks before the date, 50% within two weeks, and 100% within 48 hours. Rescheduling also comes first if the diary allows.
  5. If R Fotografie cancels outside Article 4, all sums paid are refunded in full.

Article 9 — Force majeure

  1. Force majeure means circumstances beyond R Fotografie’s control that make performance reasonably impossible or unacceptably onerous, including illness, accidents, extreme weather, strikes, travel restrictions and government measures.
  2. For temporary force majeure, the assignment is rescheduled by agreement. For permanent force majeure, either party may terminate. R Fotografie may charge for work already performed and non-refundable costs incurred; any balance is refunded within 14 days.
  3. Article 4 on photographer absence takes precedence for force majeure relating to a person.

Article 10 — Performance and delivery

  1. R Fotografie performs the assignment to the best of its knowledge and ability in its own documentary, narrative style, which the client can assess beforehand.
  2. Delivery: regular shoots within four weeks and weddings within ten weeks of the assignment. If delay threatens, R Fotografie gives timely notice and a new reasonable deadline. For weddings, an initial small preview is also delivered through the gallery within three days.
  3. Delivery is through a personal gallery protected by both a password and PIN. The client chooses which images to share with guests. Each image is supplied at full resolution for printing and in a lighter web and social media version. A wedding includes at least 300 images with Basis, 450 with Favoriet or 600 with Luxe; these are minimums, not caps. Other image counts and extra albums follow the proposal. The wedding gallery stays online for six months with Basis or 12 months with Favoriet and Luxe, from delivery. For up to two years after delivery, R Fotografie retains a backup and, on request, provides the images again through an emailed download link. Afterwards the client is responsible for storage.
  4. Image selection and editing are artistic decisions of R Fotografie. Unedited RAW files are not supplied unless expressly agreed.
  5. Complaints and correction: if the client reports a demonstrable defect, R Fotografie first has a reasonable opportunity to put it right, for example by re-editing or additional delivery. A request to report defects preferably within five working days does not limit statutory rights.
  6. Album: every wedding package includes a 15 × 15 cm album with Basis and Favoriet or a 20 × 20 cm album with Luxe. R Fotografie selects images for the included album under paragraph 4. If a larger album is chosen on booking, it is discounted by 10% and replaces the included album. The client chooses moments for the larger album; R Fotografie makes a shortlist and designs it, shows the design for feedback before printing, and the album supplier’s warranty stated in the proposal applies.
  7. Drone: drone images are a best efforts obligation, not a guaranteed result. Flying depends on weather, location and applicable rules. If flying is impossible, no discount, refund or replacement delivery is owed.

Article 11 — Copyright and image use

  1. Copyright in all images belongs to R Fotografie (Romy and/or Rolf).
  2. Private clients receive a non-exclusive, perpetual licence for personal use: prints, sharing with family and friends, and posting on their own social media for non-commercial purposes, without edits that harm the work’s integrity, such as filters or destructive crops, and with attribution to “R Fotografie” where reasonably possible.
  3. Business clients receive the rights in the proposal (purposes, channels, term and territory). Broader use, resale or sublicensing to third parties requires prior written permission.
  4. Images may not be used to train AI models or commercially exploited outside the rights granted.
  5. R Fotografie uses images for its portfolio, website, social media, trade publications or relevant suppliers only with the client’s consent. At booking, the client explicitly chooses each purpose in the proposal or confirmation. Explicit consent by email, WhatsApp or verbally also counts if R Fotografie records it. Silence or lack of objection does not count.
  6. Consent is purpose specific and does not automatically cover other channels. It may be withdrawn for future use at any time, free of charge, through the contact page. We remove existing publications within 30 days where reasonably possible. Refusal or withdrawal does not affect price, scheduling, selection or delivery.
  7. Where several people are recognisable, R Fotografie selects carefully and does not publish images of guests likely to object or in cases of doubt. Recognisable images of minors require a parent’s or guardian’s consent.
  8. This article does not limit portrait rights: for a portrait made on commission, the person portrayed decides on publication (Article 20 of the Dutch Copyright Act).

Article 12 — Liability

  1. R Fotografie is liable only for direct loss arising from an attributable failure and only up to the invoice amount of the assignment concerned.
  2. Liability for indirect or consequential loss, lost income and non-material loss is excluded to the extent the law permits.
  3. These limits do not apply to intent or deliberate recklessness by R Fotografie and do not limit mandatory consumer rights.
  4. R Fotografie is not liable for lost images due to force majeure or processor circumstances that it could not reasonably prevent, provided it demonstrably took appropriate measures, including redundant storage during the assignment and encrypted backups. In that case, restoration or refund of the amount paid is the sole remedy.

Article 13 — Personal data

Personal data is processed in accordance with R Fotografie’s privacy notice (the version in force at booking) and the General Data Protection Regulation.

Article 14 — Governing law and disputes

  1. Dutch law applies to these terms and every contract, including assignments carried out wholly or partly in Italy, subject to mandatory provisions of the law of the consumer client’s country of residence.
  2. The parties first try to resolve disputes through discussion. Disputes go to the competent court in the district where R Fotografie is established, unless mandatory law designates another court.
